This terms and conditions page describes the terms upon which you may access and use the Site. By visiting the Site, you affirm that you have read and accept all of the following terms and conditions, which may be updated by us from time to time without notice. By accessing, browsing and/or using the Site, you acknowledge that you have read, understood, and agree, to be bound by the terms and conditions and the terms of the Privacy Policy, which is incorporated by reference into the terms and conditions, and to comply with all applicable laws, rules and regulations associated with your use of the Site.

1. Grant of Rights. SAVE100BUCKS.COM grants you a limited, revocable, non-exclusive right to access and use the Site in accordance with these terms and conditions. By accessing, browsing or using SAVE100BUCKS.COM, you acknowledge that you have read, understood and agreed to the terms and conditions contained herein and that you further agree to the terms of the privacy policy.

2. Ownership of Copyrights, Trademarks and Other Intellectual Property. You acknowledge that SAVE100BUCKS.COM owns the copyright and all other intellectual property rights to the Site. Any trademarks contained on the Site are the trademarks of their respective owners.

3. Registration. Although you may use many parts of the site without registering, in order to qualify to receive a payment of $100 (which may be in the form of check or a prepaid gift card), you must register for an account. If you choose to register for an account on the Site, you agree to provide correct and accurate information about yourself as requesting in the registration section. If SAVE100BUCKS.COM for any reasons finds improper use of the site or any information provided by you on the registration form to be untrue, incomplete or inaccurate, SAVE100BUCKS.COM reserves the right to suspend or further terminate your membership to the site, and further refuse any and all use of the site or benefits thereof, in its sole discretion. Use of the user name and password of the account holder are the sole responsibility of the registered person and use of such user name and password by any person other then the user is the user's responsibility to ensure that the use of their account fully complies with the terms and conditions. Therefore, you are responsible for protecting your user name and password. You further acknowledge that SAVE100BUCKS.COM may send you information or notifications to your email account or via other communication tools (ie. text message) as provided in your registration, regarding your account based on the information you provided or when requested to do so by you. SAVE100BUCKS.COM is not responsible or liable for any situation that may arise from your failure to update and maintain accurate personal information with the Site. You acknowledge and agree that if you fail to maintain accurate and updated information, it may result in your failure to receive important notices or rewards from the Site.

4.Qualifying for $100 Payment. Users who have successfully registered with the Site may have the opportunity to redeem one hundred dollars ($100.00) after the purchase of a new or used vehicle from one of the car dealers participating on the Site. Payment of the $100 will occur only if (i) the user is properly registered with the Site prior to 10:00 a.m. (local time) on the date of the purchase of a new or used car from a car dealer that is participating on the Site on the date of such registration, (ii) registration is active at the time of the purchase of the vehicle (i.e., purchase occurs within 120 days following initial registration or within 120 following reactivation of registration whichever is applicable), (iii) the vehicle is not returned following its purchase and (iv) the user provides proof of purchase if so requested, (v) redemption occurs within 60 days following the purchase of the vehicle and (vi) the car dealer from whom the vehicle was purchased makes all required payments to the Site as a result of such purchase. Payment of the $100 is expected to be made within 6-10 weeks from the date that the user reports the purchase to the Site suing the automated feature on the Site for reporting the purchase; provided , in no event will any payment be made to any user of the Site prior to the Site receiving payment relating to such purchase from the participating dealer at which the purchase occurred. The Site shall in no way be responsible or liable for failure of any participating dealer to make such payment to the Site and no claim shall be made against the Site for failure of the dealer to make such payment (or the resulting failure of the site to make a payment to a user). For purposes of this Agreement, a purchase shall occur only upon the user paying for the vehicle in full (including as a result of any financing to which the user agrees). In the event a user receives a $100 payment from the Site and subsequently returns the vehicle to which such payment relates, the $100 payment shall be treated as an offset against any amount owed by the dealership to such purchaser upon such return.

5. Tell-A-Friend. SAVE100BUCKS.COM includes a feature by which users of the site may qualify for a payment of $25 (the "tell-a-friend referral fee") if they refer another user and that user subsequently qualifies for payment of $100 from the site. Only the first user that provides the Site with the e-mail address of another person who has not previously registered on the Site will qualify for a tell-a-friend referral fee. No user who refers themself or any other member of their immediate family will qualify for a tell-a-friend referral fee. All decisions with regard to whether or not a user qualifies for a tell-a-friend referral fee will be made by SAVE100BUCKS.COM in its sole discretion

6. Third Party Content. You acknowledge that the content on SAVE100BUCKS.COM is provided for informational purposes only. The Site provides users with the opportunity to receive additional savings of $100 otherwise not offered without the use of the Site. Price quotes and package details and vehicle descriptions and other information are provided by third parties and SAVE100BUCKS.COM accepts no liability for the erroneous information provided on the Site. SAVE100BUCKS.COM is a distributor that provides an online platform for users to configure new vehicles, receive price quotes, search inventory of new or used vehicles and locate car dealers affiliated with the Site within their search area (the "Content"). SAVE100BUCKS.COM is not a car dealer or car seller itself. Human or other error, by no intentional fault of the Site or a participating dealer, may occur and result in an unintentional, but material, error in the entry of some Content of the vehicle on the Site. SAVE100BUCKS.COM is only a distributor of Content, and users hereby agree that reliance on the Content provided on the Site is at their own risk and users agree to release SAVE100BUCKS.COM, participating auto dealers and their respective affiliates, including parent and subsidiary entities, and the owners, stockholders, directors, officers, employees, and agents of each of them, from any and all claims, demands, loss or damages of any kind incurred as a result of, or in connection with, any Content on the Site. SAVE100BUCKS.COM encourages its users, upon purchase of any vehicle listed on the Site or from any dealer participating on the site to thoroughly read and review any documents related to the purchase of the vehicle prior to signing any agreement. SAVE100BUCKS.COM plays no role in the negotiation or sales transaction between the user and the dealer and you agree to release SAVE100BUCKS.COM, its affiliates, including parent and subsidiary entities, and the owners, stockholders, directors, officers, employees, and agents of each of them, from any and all claims, demands, loss or damages of any kind incurred as a result of, or in connection with, and transactions or negotiations you may enter into with any of the dealers participating on the site. SAVE100BUCKS.COM is not a party to any agreement, contract or loan made between the user and the dealer.

7. Termination of Access. SAVE100BUCKS.COM has the right to limit or terminate your access to the Site for any reason if we believe you have violated any of these terms and conditions. You agree that SAVE100BUCKS.COM will have no liability with regard to any such limitation or termination.

8. Limitations. SAVE100BUCKS.COM reserves the right at any time to modify, suspend or discontinue the Site (or any part thereof) with or without notice, and we are not liable to you or any third party for any modification, suspension or interruption in services. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND NO GUARANTEES OR WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS WARRANTIES OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, NONINFRINGEMENT, PERFORMANCE, INFORMATIONAL CONTENT, ACCURACY, OR SYSTEM INTEGRATION, ARE MADE WITH RESPECT TO THE SITE, INCLUDING THE INFORMATION CONTAINED ON THE SITE. SAVE100BUCKS.COM MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, WITHOUT DEFECT OR ERROR FREE. IN NO EVENT SHALL SAVE100BUCKS.COM BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE OR LOSS OF USE, ARISING OUT OF YOUR USE OF THE SITE, EVEN IF SAVE100BUCKS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE AND AGREE THAT ANY DATA OR MATERIAL OBTAINED THROUGH THE USE OF THE SITE IS AT YOUR OWN DISCRETION AND RISK.

9. Links to Other Web Sites. Solely as a courtesy to you and to our participating dealerships, we provide links to other web sites at certain places on the Site; we do not endorse, approve, certify or control any of those web sites. Because we do not have any control over such sites, you acknowledge and agree that we are not responsible for the content of the sites or the availability, accuracy, completeness, effectiveness, or timeliness of information contained on those sites. Use of those sites or any information obtained from those sites is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy and timeliness.

10. Intellectual Property Infringement. If you believe that any material appearing on Save100Bucks.com infringes on your intellectual property rights, please contact us through our contact us form, which will go to our designated agent. We reserve the right to remove content for any reason.

11. No Unauthorized Duplication. No content on the Site may be copied, changed republished, distributed, downloaded, sold, compiled or in any other way used except as clearly intended to be used by individual users on the site without the prior, written consent of SAVE100BUCKS.COM

12. Governing Law. Any dispute with respect to the Site shall be governed by the laws of the State of Maryland, excluding its conflicts of laws rules. All visitors to the Site submit to the exclusive jurisdiction of the state and/or federal courts of the State of Maryland and agree that any and all disputes relating to the Site, to the content posted thereon or otherwise involving SAVE100BUCKS.COM or its affiliates, including parent and subsidiary entities, and the owners, stockholders, directors, officers, employees, and agents of each of them, shall be prosecuted solely in such jurisdiction.

13. Indemnity. You agree to indemnify and hold SAVE100BUCKS.COM, the participating auto dealers and their respective affiliates, including parent and subsidiary entities, and the owners, stockholders, directors, officers, employees, and agents of each of them, of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, liability, loss, cost or expense, of any nature whatsoever, known or unknown, fixed or contingent (hereinafter referred to as "Claims") which arise from, or are related to, your use of the Site, or your violation of these terms and conditions.

14. Compliance With Law. SAVE100BUCKS.COM is restricted to use only by visitors located in states where the functions of the Site and the participation by participating dealerships is in compliance with all laws. SAVE100BUCKS.COM reserves the right to make its features availiable only in those jurisdictions where such features are permitted by all laws.

15. No Effect on Agreements. Nothing on the Site shall be construed to add or modify terms to any existing or future agreements with SAVE100BUCKS.COM.

17. Notices. In our discretion, we may provide notices of changes to these terms and conditions or other matters by displaying notices or links to notices generally on the Site. Such notices, however, are not required in order for us to change the Terms and Conditions applicable to the Site and we may change the Terms and Conditions solely by making changes to the content on this page.

18. Severability/Waiver. You acknowledge and agree that if any provision of these terms and conditions is invalid or unenforceable to any extent, the remainder of these terms and conditions shall not be affected and shall be enforced to the greatest extent permitted by applicable law. You also acknowledge and agree that any failure by SAVE100BUCKS.COM to enforce any of its right shall not constitute a waiver of such right and any waiver of any violation of these Terms and Conditions shall not constitute a waiver of any future violation.
